1. Definitions

“App” means the Do It Right Productions application, website, software, platforms, databases, systems, services, features and associated technology.

“Do It Right Productions” means the company or legal entity operating and owning the App and its associated intellectual property.

“Do It Right IP” means all intellectual property owned, created, developed, commissioned, acquired, licensed or otherwise controlled by Do It Right Productions.

“User” means any person who accesses or uses the App.

“User Content” means photographs, videos, text, documents, profile information or other material submitted or uploaded by a User.

“Event” means any tournament, competition, grading, examination, seminar, course, training event or other activity administered or supported through the App.

2. Acceptance of these Terms

By using the App, you confirm that: you have read and understood these Terms; you agree to be bound by them; the information you provide is accurate; you have authority to enter into these Terms where required; you will comply with applicable laws; you will respect the intellectual-property rights of Do It Right Productions and others; and you will use the App only for its intended and lawful purposes.

Where applicable law requires additional consent, parental consent, guardian consent or other authorisation, that requirement continues to apply regardless of acceptance of these Terms.

3. Age requirements and children

You must be at least 13 years old to independently create and maintain an account, unless a higher minimum age is required by the laws applicable to you.

If you are under 18, you must use the App with the permission and supervision of a parent, legal guardian or authorised instructor where required by applicable law or by the relevant App feature.

Where applicable law requires parental or guardian consent for the processing of a minor’s personal information, that consent must be obtained before the relevant information is processed.

Do It Right Productions may require age verification, parental consent, guardian consent or other verification before allowing access to particular features.

We may restrict, suspend or terminate an account where we reasonably believe that an age or consent requirement has not been satisfied.

Nothing in these Terms is intended to reduce or remove any legal protection afforded to children.

4. Account information

You must provide accurate and current information when creating or using an account.

Depending on the services you use, this may include full name, date of birth, gender, photograph, belt rank, weight, instructor, dojang or club, federation or organisation, competition information, grading information, umpire information, certification information and other information necessary to provide the requested service.

You must not knowingly provide false or misleading information.

Where information is used to determine competition divisions, deliberately entering false information may result in correction, disqualification or other action by the relevant organiser.

5. Account security

You are responsible for maintaining the confidentiality of your account credentials.

You must not share your login credentials, allow another person to use your account, access another person’s account, impersonate another person, create fraudulent accounts, circumvent account restrictions, attempt to obtain another person’s credentials, or permit unauthorised access to your account.

You must notify Do It Right Productions promptly if you believe your account has been compromised.

You are responsible for activity conducted through your account to the extent permitted by applicable law.

6. User roles and permissions

The App may provide different roles, including Student, Instructor, Umpire, Organiser, Administrator, Official and other roles introduced by Do It Right Productions.

Each role may have different permissions.

Users with elevated permissions must only use those permissions for legitimate purposes for which they are authorised.

An organiser or administrator must not use access privileges to obtain, modify, disclose or distribute information unrelated to their legitimate responsibilities.

7. Acceptable use

You must not use the App to engage in unlawful activity; upload unlawful, abusive, threatening, hateful, harassing, obscene or fraudulent content; impersonate another person or organisation; create misleading profiles; obtain unauthorised access to accounts or systems; access information you are not authorised to access; manipulate scores, results, rankings, brackets, grading results, attendance or certifications; interfere with tournament operations or officiating; introduce malware or malicious code; scrape or harvest information; use bots or automated extraction tools; circumvent technical restrictions; reproduce proprietary content; create competing products; misuse personal information; sell access to the App; redistribute App content; use the App to train an AI or machine-learning system without written permission; use another person’s identity without lawful authority; or otherwise violate these Terms or applicable law.

Do It Right Productions may take reasonable action where these requirements are breached.

8. Ownership of the App

The App, and all material created, developed, commissioned or owned by Do It Right Productions, remains the property of Do It Right Productions or its applicable licensors.

Nothing in these Terms transfers ownership of Do It Right IP to a User.

Your right to use the App is a limited, personal, revocable, non-exclusive and non-transferable right to use the App for its intended purpose.

9. Do It Right intellectual property

Do It Right IP includes, without limitation:

Software: source code, object code, application code, backend code, frontend code, APIs, software architecture, application architecture, database architecture, database structures, algorithms, programming logic, business logic, workflows, system logic, technical specifications, technical documentation, security systems, integrations, interfaces and infrastructure.

App Systems: tournament management, tournament registration, competition management, competition brackets, scoring, judging, umpire management, grading management, ranking, leaderboards, certification, attendance, scheduling, event management, dojang management, student management, instructor management, course management, training management, notifications, results, reporting and other proprietary systems developed for the App.

Creative Material: photographs, videos, instructional videos, diagrams, illustrations, animations, graphics, icons, written material, instructional explanations, training material, course material, educational material, pattern reference material, documentation, designs, layouts, screen designs, user interfaces, user experience designs and other original creative material.

Branding: Do It Right Productions, App names, product names, service names, logos, trademarks, trade names, domain names, slogans, icons, branding, visual identity and associated goodwill.

Business and Development Material: product concepts, specifications, development plans, product roadmaps, unreleased features, prototypes, business processes, proprietary methods, confidential development material, improvements, modifications, adaptations and derivative works.

10. No transfer of ownership

Access to the App does not give you ownership of the software, source code, databases, App systems, designs, content, branding, tournament systems, grading systems, ranking systems or any other ownership interest in Do It Right IP.

No licence or right is granted except where expressly stated in these Terms.

No implied licence is created by your access to or use of the App.

11. Strict prohibition on screenshots and recordings

Unless Do It Right Productions gives you prior written permission, you must not capture, reproduce or distribute proprietary App material by any method.

This includes screenshots, screen recordings, photographs of screens, video recordings, camera recordings, screen captures, copied interfaces, copied diagrams, copied videos, copied instructional material, copied course material and extracted images.

You must not publish screenshots, publish screen recordings, upload App recordings to social media, distribute App recordings, send App screenshots to third parties, reproduce App screens elsewhere, use App recordings in another product, use screenshots to advertise another service, use captured material to train another system, use captured material to create a competing product, or commercially exploit captured App material.

This prohibition applies regardless of the device or technology used.

The fact that a device technically permits a screenshot, photograph or recording does not constitute permission from Do It Right Productions to reproduce or distribute the captured material.

Unauthorised capture, reproduction or distribution may constitute a breach of these Terms and may also infringe applicable intellectual-property rights.

12. Source code, reverse engineering and technical protection

You must not, except where applicable law expressly permits otherwise, reverse engineer the App, decompile the App, disassemble the App, decode the App, attempt to obtain source code, copy source code, extract object code, extract algorithms, extract database structures, extract APIs, reproduce internal systems, bypass technical protection, interfere with security, inspect proprietary server-side systems, modify the App, create derivative software, reproduce the App’s architecture, or assist another person in doing any of these things.

Where a legal exception cannot lawfully be excluded, that exception applies only to the minimum extent required by law.

13. No copying or creation of competing products

You must not use the App or Do It Right IP to create, develop, operate, market or assist with a competing product.

This includes copying or substantially reproducing the App’s functionality, tournament systems, grading systems, ranking systems, scoring systems, bracket systems, certification systems, user interfaces, workflows, database structures, business logic, system architecture, course systems, competition-management systems or other proprietary systems.

This restriction applies whether copying is direct, indirect or achieved through adaptation.

14. Names, trademarks and branding

You must not use Do It Right Productions’ names, trademarks, logos, branding or confusingly similar marks without prior written permission.

You must not create confusingly similar app names, business names, domains or social-media accounts; imply affiliation, sponsorship or endorsement by Do It Right Productions; or use Do It Right branding to promote another product or service.

15. User content

You retain ownership of User Content that you lawfully own and upload.

By uploading User Content, you grant Do It Right Productions a non-exclusive, worldwide, royalty-free licence to host, store, process, reproduce, display and distribute that content as reasonably necessary to operate the App, provide the relevant feature, administer events, maintain records, provide requested services, display profiles, administer competitions, provide rankings, provide grading services, provide certification services and legitimately promote the App and its services.

You represent that you have the necessary rights, permissions and authority to upload the content.

You must not upload content that infringes another person’s rights.

16. Image, name and likeness

Where a User voluntarily creates a profile, enters a tournament, participates in a grading, uploads a photograph or video, completes a course, receives a certification or otherwise provides their name, image, likeness or profile information to the App, the User grants Do It Right Productions a non-exclusive, worldwide, royalty-free licence to use that material as reasonably necessary to provide, operate, administer and legitimately promote the App and its services, subject to applicable law.

This may include name, photograph, video, likeness, belt rank, grading information, tournament participation, competition results, ranking, tournament history, dojang, club, instructor, umpire status, official status, certification, course participation, achievements and other information voluntarily submitted for the relevant feature.

17. Tournament and competition display

A User’s name, competition entry, division, bracket position, result, ranking, grading result or certification information may be displayed where reasonably necessary for the operation and administration of the relevant App feature.

This may include event entries, brackets, scoreboards, results, rankings, leaderboards, grading records, certificates, competition histories, instructor lists, umpire lists, dojang listings and other legitimate event records.

18. Promotional use of user material

Where a User voluntarily provides an image, video, name, achievement, result or other profile material for use through the App, Do It Right Productions may use that material to promote the App, Do It Right Productions, tournaments, competitions, courses, gradings, certifications, training services, ranking systems, tournament systems and related services, subject to applicable law and the Privacy Policy.

Do It Right Productions will not knowingly represent that a person endorses a product, service or organisation where no such endorsement exists.

19. Minors and parent/guardian consent

Where a minor appears in a photograph, video or other User Content, the person uploading the material must obtain any parental or guardian consent required by applicable law.

Where Do It Right Productions requires direct consent from a parent or guardian, the relevant parent or guardian must provide that consent.

A parent or guardian may be required to create or authorise an account, approve participation, approve competition registration, approve an indemnity, approve image/video use, approve relevant data processing or provide other legally required consent.

Do It Right Productions may refuse or restrict participation where required consent has not been obtained.

20. Historical and educational material

Do It Right Productions may use names, historical information and other material concerning Taekwon-Do practitioners, instructors, masters, pioneers, umpires, competitors and historical figures for legitimate educational, historical and informational purposes where Do It Right Productions has a lawful basis or appropriate rights to do so.

The use of a person’s name or historical information does not automatically mean that the person endorses, sponsors or is affiliated with Do It Right Productions.

Third-party copyright, trademark, personality, publicity, privacy and other rights remain with their respective owners.

21. Third-party intellectual property

Nothing in these Terms gives Do It Right Productions ownership of intellectual property belonging to another person or organisation.

Third-party material may be used only where Do It Right Productions has ownership, permission, a licence, another lawful right or another legally recognised basis for its use.

Where third-party material is identified as belonging to another rights holder, those rights remain with that rights holder.

22. ITF Taekwon-Do material

The App may use ITF Taekwon-Do terminology, technique names, pattern names, historical information and other terminology for educational and informational purposes.

Unless expressly stated otherwise, Do It Right Productions is an independent product and is not an official publication, application or platform of any particular ITF federation or governing organisation.

The use of terminology does not transfer ownership of Do It Right Productions’ original photographs, videos, diagrams, explanations, instructional material, software, databases, systems or other original content.

23. Tournaments, gradings and officiating

The App provides technological tools to assist with events.

Unless expressly stated otherwise, Do It Right Productions is not the sanctioning authority for an Event.

The Event organiser remains responsible for event rules, officials, venue, participant eligibility, safety, insurance, medical arrangements, competition decisions, final results and compliance with the rules of the relevant federation or organisation.

Do It Right Productions provides technology and does not replace the responsibilities of the Event organiser.

24. Electronic indemnities and electronic acceptance

Where the App provides an electronic indemnity, consent, waiver, declaration or acceptance form, the User may be required to confirm acceptance electronically.

Subject to applicable law, selecting an acceptance box, button or equivalent electronic confirmation may constitute the User’s electronic acceptance or electronic signature.

A User must not falsely accept an indemnity, waiver, declaration or consent on behalf of another person.

Where a minor is involved, any parent or guardian acceptance must be provided by the person legally authorised to provide it.

Electronic records may be retained as evidence of the acceptance provided through the App, subject to applicable law and the Privacy Policy.

25. Official records

Scores, brackets, timings and results displayed by the App reflect information entered into the system.

Where an official Event record differs from the App’s display, the official record maintained by the authorised Event organiser will prevail, subject to applicable law and the rules of the relevant organisation.

Do It Right Productions is not responsible for incorrect information supplied to the App by organisers, officials or Users.

26. Certification

Any instructor, umpire or other certification issued through the App reflects the relevant Do It Right Productions course, assessment or examination.

Recognition of such certification by a federation, organiser, employer, dojang or other organisation is determined by that organisation.

Unless expressly stated otherwise, Do It Right Productions does not guarantee recognition of certification by any third party.

27. Physical training and health

Taekwon-Do and physical training involve inherent risks, including the possibility of serious injury.

The App’s training material, patterns, stances, kicks, techniques, sparring information, fitness material and other physical instruction is provided for educational and reference purposes.

The App does not replace qualified, supervised instruction.

You are responsible for training within your ability and following appropriate safety procedures.

You should obtain appropriate professional medical advice where necessary before undertaking physical training or competition.

Nothing in these Terms excludes liability that cannot legally be excluded.

28. Privacy

Your use of the App is also subject to the Do It Right Productions Privacy Policy.

Personal information may include names, dates of birth, photographs, videos, competition information, belt ranks, rankings, grading information, certification information, contact information and other information necessary to provide the App’s services.

Personal information will be handled in accordance with applicable privacy and data-protection law.

Where different laws apply to different Users, Do It Right Productions will apply the mandatory requirements applicable to the relevant processing and User.

29. Children’s data

Where the App is accessed by children or processes children’s personal information, Do It Right Productions will apply appropriate safeguards required by applicable law.

This may include age-appropriate notices, parental or guardian consent, additional verification, restrictions on certain features, restrictions on targeted advertising, restrictions on profiling, additional security, additional deletion rights and other safeguards required by applicable law.

Nothing in these Terms authorises Do It Right Productions to disregard mandatory children’s privacy protections.

30. Confidential information

You must keep confidential any non-public information provided through the App that is reasonably understood to be confidential or proprietary.

This includes source code, technical architecture, security information, unreleased features, development plans, product roadmaps, prototypes, business processes, commercial information, pricing information, internal systems, databases, proprietary methods and other non-public information.

These obligations continue after termination to the extent permitted by law.

31. Security vulnerabilities

If you discover a security vulnerability, exposed credentials, source-code exposure, unauthorised access, a database vulnerability, copied proprietary material or another security issue, you must notify Do It Right Productions promptly.

You must not exploit, sell, publish, distribute or otherwise misuse the information.

32. Availability of the App

We aim to keep the App available and accurate but do not guarantee uninterrupted availability.

The App is provided on an “as is” and “as available” basis to the maximum extent permitted by applicable law.

Features may be added, changed, modified, suspended, replaced or removed.

Live features may depend upon internet connectivity, mobile networks, venue infrastructure, hardware, third-party services and other factors outside our control.

33. Third-party services

The App may integrate with or depend upon third-party services.

Do It Right Productions is not responsible for the independent operation, availability, security, content or policies of third-party services.

Your use of third-party services may be subject to their own terms and privacy policies.

34. Account suspension and termination

Do It Right Productions may suspend or terminate access where these Terms are materially breached, the law requires it, security requires it, intellectual-property rights are infringed, another User is placed at risk, the App is being abused, fraudulent activity is detected or continued access creates a legitimate risk to Do It Right Productions or its Users.

Where reasonably practicable, we may provide notice or an opportunity to address the issue.

Immediate suspension may occur where necessary to protect security, Users, intellectual property or legal rights.

35. Effect of termination

Upon termination, your right to use the App ends; you must stop using Do It Right IP; you must stop reproducing proprietary material; you must stop distributing captured App material; and you must cease any unauthorised use of Do It Right IP.

Termination does not transfer ownership of anything to you.

Provisions relating to intellectual property, confidentiality, liability, indemnity, disputes and other provisions that by their nature should survive termination will continue to apply.

36. Intellectual-property rights survive termination

Termination of an account does not terminate Do It Right Productions’ ownership of its intellectual property.

Any unauthorised copies, recordings, screenshots, source-code copies, extracted databases or other proprietary material remain subject to Do It Right Productions’ rights.

Where legally required, you must delete, return or cease using unauthorised copies.

37. Indemnity

To the maximum extent permitted by applicable law, you agree to indemnify Do It Right Productions and its directors, officers, employees, contractors and service providers against claims, losses, liabilities, costs and expenses arising from your breach of these Terms, unlawful use of the App, User Content, infringement of another person’s intellectual property, unauthorised copying or distribution of App material, misuse of another person’s personal information, fraudulent use of the App or violation of applicable law.

This clause does not apply to the extent that applicable law prohibits such indemnification.

38. Limitation of liability

To the maximum extent permitted by applicable law, Do It Right Productions will not be liable for indirect, incidental, special, consequential or unforeseeable losses.

This may include loss of profits, loss of business, loss of opportunity, loss of data, loss arising from rankings, loss arising from brackets, loss arising from competition results, loss arising from grading decisions, loss arising from certification decisions or service interruption.

However, nothing in these Terms excludes, restricts or limits any liability, right, remedy, warranty, guarantee or protection that cannot lawfully be excluded, restricted or limited under the law applicable to you.

Nothing in these Terms is intended to exclude liability for fraud or for death or personal injury caused by negligence where such exclusion is prohibited by applicable law.

39. Consumer rights

Nothing in these Terms is intended to remove or reduce mandatory consumer rights.

If the law of your country gives you rights that cannot legally be excluded by contract, those rights continue to apply.

If any provision of these Terms is unenforceable in a particular jurisdiction because it conflicts with mandatory law, that provision will be limited or modified only to the extent necessary in that jurisdiction.

The remainder of the Terms will continue to apply.

40. Governing law and mandatory local rights

These Terms are governed by the laws of the Republic of South Africa, except to the extent that mandatory law in the User’s country or jurisdiction requires otherwise.

The courts of South Africa shall have non-exclusive jurisdiction over disputes, subject to any mandatory rights a User may have to bring proceedings in another jurisdiction.

Nothing in this clause prevents a consumer from relying on mandatory consumer protections or mandatory jurisdictional rights that cannot legally be waived.

41. International use

Do It Right Productions operates from South Africa but may make the App available internationally.

Different countries may have different laws concerning privacy, children, consumer protection, electronic contracts, intellectual property, image and likeness rights, advertising, taxation, competition, health and safety and online services.

Where mandatory local law applies, that law will prevail over any conflicting provision of these Terms only to the extent required.

42. Changes to the Terms

We may update these Terms as the App develops, laws change or new services are introduced.

Where legally required, we will provide appropriate notice of material changes.

The updated Terms will identify their effective date.

Where continued use cannot legally constitute acceptance of amended terms, Do It Right Productions will obtain any additional acceptance required by law.

43. Severability

If any provision is found to be unlawful, invalid or unenforceable in a particular jurisdiction, it will be modified or limited only to the extent necessary to make it enforceable where legally possible.

The remaining provisions remain in effect.

An invalid provision in one jurisdiction does not automatically invalidate the same provision in another jurisdiction.

44. No waiver

A failure or delay by Do It Right Productions to enforce a provision of these Terms does not constitute a waiver of that provision or any other right.

A waiver must be expressly given by an authorised representative of Do It Right Productions.

45. Entire agreement

These Terms, together with the Privacy Policy, applicable Competition Terms, applicable Indemnity or Consent, applicable subscription or payment terms and other terms expressly incorporated into the App, constitute the agreement between you and Do It Right Productions concerning your use of the App.

No transfer of Do It Right Productions’ intellectual property occurs unless expressly agreed in a separate written agreement signed by an authorised representative of Do It Right Productions.

46. No implied rights

Except where expressly stated in these Terms or required by applicable law, no User receives any ownership, licence, copyright permission, trademark permission, patent permission, database right, design right, publicity right, commercialisation right or other intellectual-property right merely because the User accesses or uses the App.

48. Important notice

These Terms are intended to establish the contractual rules governing use of the App internationally.

They do not attempt to remove mandatory legal protections that apply to Users in their country of residence.

Where mandatory law gives a User greater protection than these Terms, that mandatory protection applies to the extent required by law.

Where a User has a legal right that cannot be waived, nothing in these Terms is intended to waive that right.

All other provisions remain fully applicable.
